MINOR PARTICIPATION WAIVER, RELEASE OF LIABILITY AND ASSUMPTION OF RISK
This Waiver and Release of Liability (“Waiver”) is executed by the undersigned parent or legal guardian (“Parent/Guardian”) on behalf of the minor participant (“Minor”) in connection with participation in fitness training, athletic programs, classes, assessments, and related activities (the “Activities”) provided by FitVibe LLC.
1. Acknowledgment of Risk
I understand that participation in fitness and athletic activities involves inherent risks, including but not limited to muscle strains, sprains, broken bones, dizziness, dehydration, overexertion, and other physical injuries. I acknowledge that these risks may result from my child’s actions, the actions of others, equipment use, or the conditions of the facility.
I voluntarily choose to allow my child to participate in the Activities with full knowledge of these risks.
2. Assumption of Risk
On behalf of myself and my child, I knowingly and voluntarily assume all risks, known and unknown, associated with my child’s participation in the Activities, even if arising from the negligence of the Company, its owners, employees, coaches, contractors, or agents, to the fullest extent permitted by California law.
3. Release and Waiver of Liability
On behalf of myself, my child, and our heirs, assigns, and representatives, I hereby release, waive, and discharge the Company from any and all claims, demands, damages, or causes of action arising out of or related to my child’s participation in the Activities, including claims for personal injury, illness, property damage, or death, except where prohibited by law.
4. Medical Representation
I represent that my child is physically able to participate in the Activities and has no medical condition that would prevent safe participation, or that such conditions have been disclosed to the Company. I understand that the Company does not provide medical advice or diagnosis.
In the event of an emergency, I authorize the Company to obtain emergency medical treatment for my child if I cannot be reached. I understand that I am responsible for all medical expenses incurred.
5. Rules and Conduct
I understand that my child is expected to follow all safety instructions and rules provided by the coaches. I acknowledge that failure to follow instructions may result in removal from the program without refund.
6. Photo and Video Release
I grant permission for the Company to use photographs or videos of my child taken during the Activities for marketing, educational, or promotional purposes, without compensation.
7. Governing Law
This Waiver shall be governed by and interpreted in accordance with the laws of the State of California.
8. Electronic Signature
I understand that by submitting this form electronically, I am providing a legally binding signature and agree that this electronic acceptance has the same force and effect as a handwritten signature.
